These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SellAnyMotor.ae ("Company," "we," "us," or "our") regarding your use of our vehicle purchasing services and website located at www.sellanymotor.ae.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use our services.

These Terms are governed by the laws of the United Arab Emirates, including but not limited to UAE Federal Law No. 5 of 1985 (Civil Transactions Law), UAE Consumer Protection Law No. 15 of 2020, and relevant Dubai and Abu Dhabi regulations.

Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts under UAE law
• Be the legal owner of the vehicle you wish to sell, or have proper authorization from the owner
• Possess valid identification (Emirates ID, passport, or residency visa)
• Provide accurate and complete information about yourself and your vehicle
• Not be prohibited from using our services under UAE law

Services Description

Our Services Include:

• Online vehicle valuation and quotation
• Physical vehicle inspection at your location
• Purchase of used, scrap, damaged, or accident vehicles
• Instant cash payment upon transaction completion
• Vehicle documentation and transfer assistance
• Vehicle collection and transportation services

Service Limitations:

• Services are available only within the United Arab Emirates
• We reserve the right to refuse service for vehicles with legal encumbrances
• Final valuations are subject to physical inspection and verification
• Online quotes are estimates and not binding offers

Vehicle Sale Process

1. Initial Valuation

You provide vehicle information through our website or phone. We provide an initial estimated valuation based on the information provided. This is not a binding offer and may change upon physical inspection.

2. Vehicle Inspection

Our team conducts a comprehensive physical inspection of your vehicle at your preferred location. The inspection assesses condition, functionality, accident history, and legal documentation.

3. Final Offer

Based on the inspection, we provide a final purchase offer. This offer is valid for 48 hours unless otherwise stated. You are under no obligation to accept the offer.

4. Transaction Completion

Upon acceptance, we handle documentation, payment processing, and vehicle transfer in accordance with RTA (Roads and Transport Authority) regulations and UAE law.

Seller Obligations and Warranties

By selling your vehicle to us, you warrant that:

• You are the legal owner with full authority to sell the vehicle
• The vehicle is free from all liens, mortgages, and encumbrances
• All information provided about the vehicle is accurate and complete
• The vehicle has not been reported stolen or involved in illegal activities
• You will provide all necessary documentation (registration card, insurance, ownership transfer documents)
• The vehicle identification number (VIN/chassis number) matches official records
• You have disclosed all known defects, damages, or accident history
• Outstanding fines, Salik charges, and parking fees will be settled before transfer

Pricing and Payment

Valuation Factors

Our valuations are based on:

• Current market conditions and demand
• Vehicle make, model, year, and mileage
• Overall condition and maintenance history
• Accident history and damage assessment
• Availability of service records and documentation
• Legal compliance and registration status

Payment Terms

• Payment is made in UAE Dirhams (AED)
• Payment methods include bank transfer, cash, or certified cheque
• Payment is processed upon completion of documentation and vehicle transfer
• All prices quoted are final and inclusive of applicable charges
• We do not charge sellers any service fees or commissions

Limitation of Liability

To the maximum extent permitted by UAE law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the purchase price of your vehicle
• We are not responsible for delays caused by government authorities, force majeure, or third parties
• Online valuations are estimates only and do not constitute binding offers
• We are not liable for any loss or damage to your vehicle while in your possession
• You are responsible for maintaining valid insurance until ownership transfer is complete

Intellectual Property Rights

All content on our website, including text, graphics, logos, images, and software, is the property of SellAnyMotor.ae and protected by UAE intellectual property laws and international copyright treaties.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

Prohibited Conduct

You agree not to:

• Provide false, misleading, or fraudulent information
• Attempt to sell vehicles you do not own or have authorization to sell
• Interfere with or disrupt our website or services
• Use automated systems or bots to access our services
• Violate any applicable UAE laws or regulations
• Engage in any activity that could damage our reputation or business
• Reverse engineer or attempt to extract source code from our website

Termination

We reserve the right to:

• Refuse service to anyone for any lawful reason
• Suspend or terminate your access to our services if you violate these Terms
• Modify or discontinue services at any time with reasonable notice

You may cease using our services at any time. Termination does not affect completed transactions or obligations that have already accrued.

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, including federal laws and the laws of the Emirate of Dubai.

Jurisdiction

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

Amicable Resolution

We encourage users to contact us first to resolve any disputes amicably before pursuing formal legal proceedings. We are committed to fair and transparent resolution of all customer concerns.

Indemnification

You agree to indemnify and hold harmless SellAnyMotor.ae, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, violation of any law, or infringement of any third-party rights.

Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid under UAE law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right shall not constitute a waiver of that right.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website with an updated "Last Updated" date.
